New regulations from the Department of Health and Human Services (HHS) establish minimum long-term care staffing requirements for residents in long-term care (LTC) facilities receiving Medicare and Medicaid funding. Some of these regulations are already active, with others being gradually implemented in the coming months and years.

These regulations require LTC facilities to provide a minimum number of care hours by nurses and nurse aides for each resident. Additionally, care hours must be documented in a manner that is auditable and readily accessible to state and federal inspectors. Failure to meet these standards could result in delayed reimbursements or fines.

The Biden-Harris Administration proposed new healthcare staffing rules in September 2023, with final rules released in April 2024 and  published in the Federal Register in May 2024. The regulations, which began to take effect in June, are being phased in over several years, with minimum standards (and the required tracking for compliance) starting in August 2024.

The key requirements are:

  • Each resident must receive 3.48 hours of nursing care per day.
  • This care must include 0.55 hours from a Registered Nurse and 2.45 hours from a nurse aide per resident per day.
  • A nurse must be on duty 24/7 in the facility.

While ensuring a nurse is always on staff is straightforward, tracking the precise amount of care each resident receives daily presents significant technical and administrative challenges.

The Financial Impact of Noncompliance

Even small errors in calculating care hours can lead to significant financial losses for LTC facilities or result in wasted taxpayer dollars. Poor or incomplete record-keeping can either leave money on the table or lead to overbilling Medicare/Medicaid. Noncompliance with the new staffing rules could result in costly fines or lost reimbursement dollars.
